1. General
These Terms & Conditions apply to all quotations, proforma invoices, sales orders, work orders, invoices, and purchases made with Smart Living.
By confirming an order or making an advance payment, the customer agrees to these terms.
2. Custom-Made Products
Most Smart Living products are manufactured specifically according to customer requirements.
Once production has commenced, the order cannot be cancelled without applicable charges.
3. Advance Payment
Production will commence only after receipt of the agreed advance payment.
The remaining balance shall be payable before or at the time of delivery unless otherwise agreed in writing.
4. Pricing
Prices are based on the specifications approved by the customer.
Any modification to:
- Dimensions
- Material
- Fabric
- Leather
- Finish
- Design
may result in revision of pricing.
5. Product Dimensions
Minor variations in dimensions (within reasonable manufacturing tolerance) may occur due to upholstery and hand-crafted manufacturing processes.
6. Color & Material Variation
Actual colours and textures may vary slightly from catalogue images or digital displays due to lighting, screen settings, and natural material characteristics.
Natural leather, wood, and fabric may exhibit inherent variations that are not considered defects.
7. Delivery Timeline
Delivery timelines are approximate and depend on:
- Production schedule
- Material availability
- Customer approvals
- Logistics
Smart Living shall not be liable for delays arising from circumstances beyond its reasonable control.
8. Delivery & Installation
Customers must ensure adequate site access before delivery.
Any additional labour, crane charges, stair handling, or special transportation required shall be borne by the customer unless otherwise agreed.
9. Inspection
Customers are requested to inspect the product at the time of delivery.
Any visible damage or shortage must be reported immediately.
10. Warranty
Warranty (if applicable) covers manufacturing defects only.
Warranty does not cover:
- Normal wear and tear
- Fabric fading
- Improper usage
- Water damage
- Fire damage
- Pet damage
- Cuts or punctures
- Unauthorized repairs
11. Returns & Cancellation
As most products are custom manufactured, returns or exchanges are generally not accepted unless there is a verified manufacturing defect.
12. Ownership
Ownership of the goods shall remain with Smart Living until full payment has been received.
13. Storage Charges
If delivery is delayed due to customer reasons beyond the agreed schedule, Smart Living reserves the right to levy reasonable storage charges.
14. Force Majeure
Smart Living shall not be liable for delays caused by events beyond reasonable control, including but not limited to natural disasters, strikes, transportation disruptions, government restrictions, or supply chain interruptions.
15. Intellectual Property
All designs, drawings, product photographs, catalogues, and marketing material remain the intellectual property of Smart Living unless otherwise agreed.
16. Commercial Use
Customers shall not reproduce or commercially manufacture Smart Living designs without prior written permission.
17. GST & Taxes
Applicable GST and statutory taxes shall be charged as per prevailing government regulations.
